the one thing left out of this discussion is age. They were THIRTEEN when the pictures were taken. That's not even borderline "ok" (not that any kiddo nudes are ok). The issue is that the girls are being punished but not the people (boys) who were passing the photos around. It IS kiddie porn by definition. And the subjects were punished. And their punishment was HARSH! They received a tougher punishment than someone who cheated on their grades. And not even a wrist slap for the people passing the photos around (they've been circulating for awhile - apparently the girls kept thinking it would die down or go away...but it hasn't).
The adults who initially saw the pictures should have contacted the parents and the authorities right away. And the girl's identity should have been protected - as willing as they may have been when the pictures were taken, they are still vicitms of this crime. Their faces have been blurred on news photos (clothes photos) but anyone locally could figure out who it is pretty easily. *sigh* As a parent, it's never easy. But this is a mistake that will follow them forever.

i agree the district screwed up, and so they should be going after the teachers jobs who "screwed up", but suing the school is looking for deep pockets. IMO are they suing the other kids who forwarded the pics, no cuz they don't have deep pockets.
